Agreement to Terms

By booking services with Nerfpalooza or using our website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services Provided

Nerfpalooza provides mobile party entertainment services, including:

• Mobile Nerf gun party rentals
• Archery Tag experiences
• Bubble Soccer rentals
• Equipment rental and setup
• Professional coaching and supervision

Booking and Payment

Reservation Requirements

• A $100 deposit is required to reserve your date and time
• The remaining balance is due before or on the day of the event
• All payments must be made in full before the event concludes
• We accept cash, credit cards, and digital payment methods

Cancellation Policy

• Deposits are non-refundable
• Weather-related cancellations may be rescheduled without penalty

Rescheduling

Events may be rescheduled before the scheduled date without penalty, subject to our availability.

Client Responsibilities

As the client, you agree to:

• Provide a safe and suitable venue for the event
• Ensure adequate space for equipment setup (minimum requirements will be discussed)
• Be present or designate a responsible adult during setup and throughout the event
• Ensure all participants follow safety rules and instructions
• Provide accurate information regarding the number of participants
• Notify us of any special needs or considerations

Safety and Liability

Safety Measures

We take safety seriously and provide protective eyewear, safety briefings, and professional supervision. All participants must follow safety rules at all times.

Waiver of Liability

By booking our services, you acknowledge that:

• Participation in activities involves inherent risks
• Participants engage in activities at their own risk
• Parents/guardians are responsible for ensuring children follow safety guidelines
• Nerfpalooza is not liable for injuries resulting from failure to follow safety instructions

Medical Information

Please inform us of any medical conditions, allergies, or special needs of participants that may affect their ability to safely participate in activities.

Equipment and Property

• All equipment remains the property of Nerfpalooza
• Clients are responsible for any damage to equipment beyond normal wear and tear
• Lost or stolen equipment must be paid for at replacement cost
• Equipment must not be modified or tampered with

Weather and Force Majeure

Outdoor events are subject to weather conditions. In case of severe weather, we reserve the right to cancel or postpone the event. We will work with you to reschedule at no additional charge. Nerfpalooza is not liable for circumstances beyond our control, including but not limited to natural disasters, government restrictions, or public health emergencies.

Conduct and Behavior

We reserve the right to refuse service or remove participants who engage in unsafe, aggressive, or inappropriate behavior. No refunds will be issued in such cases.

No refunds are issued in the case of misconductive, disruptive, and/or unsafe behavior. Nerfpalooza takes pride in running a smooth event. If the coordinator is unable to have participants comply with safety rules and follow the rules of the event, their guardians will be involved. If the guardians cannot correct the behaviors, the event may be canceled due to the risk to the coordinator's well-being.

We always want the event to run its full duration. If all circumstances are not resolved and an event is canceled early, no refunds are issued.

Photography and Media

We may take photos or videos during events for promotional purposes. By booking our services, you consent to the use of such media in our marketing materials. If you wish to opt out, please notify us in writing before the event.

Pricing and Fees

• All prices are subject to change without notice
• Quoted prices are valid for 30 days from the quote date
• Additional fees may apply for locations outside our standard service area
• A 10% insurance and equipment fee is added to all bookings
• Special promotions and discounts are subject to terms and availability

Limitation of Liability

To the maximum extent permitted by law, Nerfpalooza's liability for any claim arising from our services is limited to the amount paid for the specific event. We are not liable for indirect, incidental, consequential, or punitive damages.

Indemnification

You agree to indemnify and hold harmless Nerfpalooza, its employees, and contractors from any claims, damages, or expenses arising from your breach of these terms or from the actions of participants at your event.

Governing Law

These Terms of Service are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Los Angeles County, California.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services constitutes acceptance of modified terms.
